License Sample The following license agreement applies to ALL software on this website, unless otherwise specified: USER ACKNOWLEDGEMENTS The licensee must acknowledge that: 1. Title and ownership of the software and patents, trademarks, trade secrets and copyright relating thereto are the exclusive property of Lumonix (6631258 CANADA LTD) and their respective licensors; 2. Licensee shall only acquire the right to use the software in accordance with this agreement; 3. Licensee acknowledges that Lumonix cannot offer refunds on software or licenses; PROHIBITIONS The licensee is specifically prohibited from charging, or requesting donations, for any distribution of this software without the prior express written permission of Lumonix. The licensee may not: 1. Translate, decompile, recompile, disassemble or reverse engineer the software or documentation; 2. Copy the software for any reason other than for archival or emergency restart purposes or program error verification; 3. Sub-license, rent, or otherwise make the software available outside of the licensee's legal business entity; 4. Assign any rights under this licence agreement without the prior written consent of Lumonix; 5. Use 'Educational' versions of the software in a commercial environment without written permission of Lumonix; DISCLAIMER OF WARRANTY The software is provided by Lumonix ''as is'' and any express or implied warranties, including, but not limited to, the implied warranties of merchantability and fitness for a particular purpose are disclaimed. In no event shall Lumonix be liable for any direct, indirect, incidental, special, exemplary, or consequential damages (including, but not limited to, procurement of substitute goods or services; loss of use, data, or profits; or business interruption) however caused and on any theory of liability, whether in contract, strict liability, or tort (including negligence or otherwise) arising in any way out of the use of the software, even if advised of the possibility of such damage. GOVERNING LAW This agreement shall be governed by the laws of British Columbia, Canada.
